Eurasian Economic Union Enforces Restrictions of Use of Hazardous Substances in Electronics

On 1 March 2018, the Eurasian Economic Union enforced the Eurasian Economic Union Technical Regulation on Restrictions on use of hazardous substances in electrical and electronics products (037/2016). The Regulation is aligned with the EU RoHS 2 (Directive 2011/65/EU of the European Parliament and of the Council of 8 June 2011 on the restriction of the use of certain hazardous substances in electrical and electronic equipment).
 
A two-year transition period is provided. Thus, products subject to the regulation may comply with the current applicable EEU member state legislation until 1 March 2020.
 
The act regulates the usage of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB), and polybrominated diphenyl ethers (PBDE) in electric and electronic goods.
 
The regulation applies to equipment such as: small and large household appliances, domestic appliances, information technology equipment, telecommunications equipment, lighting equipment, tools with electric power (manual and portable electric machines), equipment for leisure and sport, vending machines, etc.
 
In addition to the restrictions on the use of certain chemicals in electrical and electronics products, the act lists requirements for circulation of these products on the market of the Eurasian Economic Union member states, including: labeling, enforcement of compliance, conformity assurance processes, etc. The standards that will support the process of compliance with the listed requirements should be published before the end of the transitional period.
 
The two year period is designed to allow manufacturers the time needed to adapt all technological processes for compliance to the new requirements, and it will also allow the conformity assessment authorities to establish the necessary EEU member states legislation.
