U.S. EPA Delivers Most Awaited TSCA Inventory With Revised Active Designations

On 12 April 2018, the U.S. Environmental Protection Agency (EPA) issued a press release of the availability of a new “Toxic Substances Control Act (TSCA) Chemical Substance Inventory.” 
 
The inventory is one of a kind, and reflects the new requirements under the amended law, i.e. active designations. Inactive designations will be published once the reporting exercise is finalized.
 
While the updated inventory accounts for the recent reset exercise that ended on 7 February 2018, industry should be aware of the second phase of the reporting exercise. That is, processors will have until 5 October 2018 to submit their voluntary Notice of Activity (NOA) Form A if a substance has not been designated as active to date.
 
The public version of the TSCA inventory contains designations for substances reported through the following mechanisms:
  • 2012 and 2016 Chemical Data Reporting cycles;
  • Notices of Commencement (NOC) dated from 21 June 2006 until 21 June 2016; and
  • Notices of Activity (NOA) Form A submitted by 7 February 2018 as required by the “TSCA Inventory Notification (Active-Inactive)” rule.
The Agency also updated the list of substances reported via NOA Forms A. The new list contains submissions made from 8 February 2018 to 30 March 2018.
 
Companies are advised to review the new inventory here, and to partake of the 5 October 2018 reporting exercise as needed.
