Delayed PCN Requirements Adopted, System-to-System Portal Aids with Compliance

On 28 October 2019 the European Commission adopted proposed legislation to delay for one year the implementation of the Poison Centre Notification (PCN) requirements for mixtures placed on the market for consumer use under the CLP Regulation(1272/2008/EC). In addition, system-to-system service is now available in the ECHA Submission portal. This functionality enables companies preparing their poison centre notifications in their own IT-systems to automate their submission to the Member State bodies through the portal.

The Commission's adoption of the delegated regulation, which is documented on the EU's Interinstitutional register of delegated acts, follows CARACAL's unanimous approval of the changes at its 31st meeting in September 2019. 

Among other changes introduced, the delegated regulation postpones the first compliance date for reporting harmonized emergency health response information to poison centres, for mixtures intended for consumer use, from 1 January 2020 to 1 January 2021. The other compliance deadlines concerning mixtures intended for professional and industrial uses are not affected.

Following its adoption, the delegated regulation is now transmitted to the European Parliament and the Council for a two-month period of scrutiny.

If no objections are raised during this period and an additional two-month scrutiny extension is not requested, the regulation will be published in the Official Journal and can then enter into force. 

The amendment is expected to become effective at the end of 2019.

As reported in September 2019, another amendment to the CLP addressing workability issues raised by industry stakeholders is expected to follow in 2020. 

The delay provides Member States with much-needed time to prepare for the upcoming regulation.
